1. INTRODUCTION

WAMP Event GmbH (“WAMP”, “we” or “us”) has issued this privacy policy for customers (hereinafter “Policy”) to describe the handling of personal data of our customers (hereinafter “you” or “your”) that is in our possession.

We respect the privacy rights of individuals and are committed to handling personal data responsibly in accordance with applicable laws. This policy discloses the personal data collected and processed about you, the purpose of the processing and your rights in this regard.

2. DEFINITIONS

With regard to the terms used, such as “processing” or “controller”, we refer to the definitions in Art. 4 of the General Data Protection Regulation (GDPR).

“Customer” means any existing or potential customer who has entered into a contractual or business relationship with WAMP for the provision of a service by WAMP.

“Personal data” means any information about a specific or identifiable natural person who is a customer. An identifiable person can be determined directly or indirectly, in particular by resorting to identifying data such as a name, an identification number, location data, online identifiers or one or more specific factors of a physical, physiological, genetic, psychological, economic, cultural or social identity of the aforementioned natural person.

“Processing” or “processed” means any operation or sequence of operations performed on personal data, whether automated or not, such as collection, recording, organization, structuring, storage, adaptation, modification, retrieval, display, use, disclosure by transmission, dissemination or otherwise making available, alignment, combination, restriction, erasure or destruction.

3. ENTITY RESPONSIBLE FOR PROCESSING YOUR PERSONAL DATA

4. TYPE OF PERSONAL DATA WE COLLECT

In connection with your relationship with WAMP, we may process the following personal data about you.

  1. Identifying data – e.g. name, date of birth.
  2. Contact details – e.g. address, telephone, email address, etc.
  3. Professional data – e.g. job title, organization, office address, etc.
  4. Financial data – e.g. account number, credit card details.
  5. National identification data – e.g. tax number and VAT ID.
  6. Information on purchase history (in particular on products and services you have purchased).
  7. Data collected from connected objects.

In order to ensure the proper execution of our contractual relationship with customers, we may also obtain certain personal data from business partners and third-party providers who provide us with specific information about your purchase history with us (including name, address, product/service purchased), from data brokers and, in some cases, from publicly available sources (e.g. courts and authorities).

5. PURPOSE OF PROCESSING YOUR PERSONAL DATA

We collect and process personal data from our customers for the following purposes:

  1. for customer account management (management of orders, invoicing, invoice receipt, debt collection, etc.);
  2. to fulfill our contractual obligations and to provide services to our customers, including via our websites;
  3. to handle inquiries, complaints or claims from our customers regarding WAMP products and services;
  4. for direct marketing, advertising and public relations in connection with WAMP’s business activities, products and services and to inform customers about significant developments at WAMP;

  6. to comply with relevant laws regarding product quality and reliability and, to the extent necessary, to comply with laws and regulations or to exercise or protect WAMP’s legal rights;
  7. to enable us to conduct our business more effectively and efficiently and to monitor and improve the quality of our services;
  8. to conduct research and development;
  9. for business development, internal reporting and the implementation of analyses and statistical studies 9. on our services;
  10. to conduct surveys, satisfaction studies and polls of our customers;
  11. for performance evaluation;
  12. to investigate legal violations or violations of WAMP regulations

6. LAWFULNESS OF PROCESSING

We collect and process necessary personal data in order to execute our agreement with you (i.e. to provide you with our products and services). In some cases, the processing of personal data may be required by applicable laws. In such cases, the processing of your personal data is necessary so that we can meet legal or contractual requirements. Without your personal data, we cannot manage our relationships with you and comply with applicable laws.

If required by applicable laws, we will ask for your prior consent before processing (e.g. for electronic direct marketing purposes).

In all other cases, we will process your personal data where such processing is in our legitimate interest and does not conflict with overriding data protection concerns or fundamental rights and freedoms (e.g. as part of our general internal business processes).

7. WITH WHOM IS YOUR PERSONAL DATA SHARED?

We only grant access to your personal data to those who need it to perform their tasks and duties, as well as to third parties who pursue a legitimate purpose with the access. Whenever we grant third parties access to personal data, appropriate measures are taken to ensure that the information is used in accordance with this policy and that the confidentiality of the information is maintained.

7.1 Disclosure to WAMP’s cooperation partners

We may share your personal data with our cooperation partners or grant them access to it in order to facilitate the management and administration of our customer accounts, for electronic direct marketing purposes and for other legitimate business purposes.

7.2 Disclosure to third-party service providers

We may also make certain personal data available to third parties if they provide services for us, e.g. as part of IT platform management or support services, infrastructure and application services, marketing, data analyses, etc. We may also make personal data available to external consultants, lawyers and advisors under the terms of data protection laws.

7.3 Disclosure to authorities

We also disclose personal data to authorities such as national tax authorities under the terms of data protection laws.

7.4 Disclosure to other third parties

We may also disclose personal data to other third parties for legitimate reasons, including:

7.4.1 to comply with our legal obligations, including compliance with laws, regulations and contracts or to comply with a court order, governmental or legal process, including but not limited to subpoenas, public audits or search warrants;

7.4.2 in response to lawful requests from public authorities (including for purposes of national security or law enforcement;

7.4.3 to the extent necessary to assert, exercise or defend against possible, threatened or pending disputes;

7.4.4 to the extent necessary to protect the vital interests of another person;

7.4.5 in connection with the sale, assignment or other transfer of the company or part thereof;

7.4.6 with your consent.

8. STORAGE, SECURITY AND TRANSFER OF PERSONAL DATA OUTSIDE THE EU/EEA

WAMP stores all personal data on its servers within the European Union (EU) and the European Economic Area (EEA). WAMP maintains appropriate administrative, technical and physical safeguards to maintain the confidentiality and security of the personal data in its possession and to protect it from accidental or unlawful destruction, accidental loss, unauthorized alteration, disclosure or access, misuse and other unlawful forms of processing. In accordance with data protection laws and internal regulations, WAMP pays attention to security at all suitable technological infrastructure points.

9. RETENTION OF PERSONAL DATA

We retain your personal data for as long as a customer relationship exists with you or as long as required by law. Generally, this means that your personal data will be retained until the end of your relationship with us or as long as there is an ongoing business concern. Personal data will be retained for direct marketing purposes until you unsubscribe from receiving marketing communications.

10. YOUR DATA PROTECTION RIGHTS

In accordance with applicable data protection laws, you have the following rights:

  1. the right to information on whether your personal data is being processed and, if so, the right to access the data and a copy;
  2. the right to rectification of inaccurate personal data and to completion of incomplete personal data;
  3. the right to erasure of your personal data and to restriction of processing of your personal data for certain legitimate reasons;
  4. the right to object to the processing of your personal data for reasons relating to your personal situation, if the processing is necessary for WAMP’s legitimate interests, unless WAMP has compelling, legitimate grounds for processing your personal data;
  5. the right to portability of your personal data if the processing is based on your consent or on a contract and the processing is carried out by automated means;
  6. the right to withdraw your consent at any time if the processing of your personal data is subject to your consent. The withdrawal of your consent has no effect on the lawfulness of processing prior to the withdrawal of consent or the processing of your personal data on the basis of processing grounds other than your consent;
  7. You also have the right to unsubscribe at any time from electronic marketing communications that we send you. You can exercise this right by clicking on the “Unsubscribe” or “Unsubscribe” link in our marketing communication.
