WAMP Event GmbH (hereinafter referred to as "WAMP", "we" or "us") provides this Privacy Statement for Customers (hereinafter referred to as the "Statement") to explain how we process personal data relating to our Customers (hereinafter referred to as "you") and held by us.

 

We respect the privacy rights of individuals and are committed to handling personal information responsibly and in accordance with applicable law. This Notice describes the personal information about you that we collect and process, the purposes for which we process it and your rights in relation to it.

1. INTRODUCTION

 

WAMP Event GmbH (hereinafter referred to as "WAMP", "we" or "us") provides this Privacy Statement for Customers (hereinafter referred to as the "Statement") to explain how we process personal data about our Customers (hereinafter referred to as "you") and which we hold.

 

We respect the privacy rights of individuals and are committed to handling personal information responsibly and in accordance with applicable law. This Notice describes the personal information about you that we collect and process, the purposes for which we process it and your rights in relation to it.

2. DEFINITIONS

 

The terminology used, e.g. "Processing" or "Data Controller": should be understood in accordance with the definitions in Article 4 of the General Data Protection Regulation (GDPR).

 

The term "Customer" refers to all existing and potential customers who have entered into a contract with WAMP to use the WAMP Services.

 

The term "Personal Data" means any data relating to an identified or identifiable natural person who is a Customer. An identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, a location, an online identifier or to one or more factors specific to the physical, psychological, genetic, mental, economic, cultural or social identity of the natural person.

 

The term "Processing" or "Processed" refers to any operation or set of operations which is performed on Personal Data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, adaptation or compilation, restriction, erasure or destruction.

 

 

 

3. THE ENTITY RESPONSIBLE FOR PROCESSING YOUR PERSONAL DATA

4. TYPES OF PERSONAL DATA WE COLLECT

 

Under your agreement with WAMP, we may process the following personal data about you:

 

1. Identifying information - such as your name, date of birth.

2. Contact information - for example, business address, telephone number/business email address, etc.

3. Professional data - e.g. title/position, affiliated organisation/office location, etc.

4. Financial information - e.g. bank account number, credit card information.

5. National identifiers - e.g. tax identification number and tax number.

Information about your purchase history (in particular, the products or services you have purchased).

We may also receive Personal Data from our business partners to ensure the proper performance of our contractual obligations with our customers, and may also be provided with specific information about your purchase history (including name, address, products/services purchased) or, in some cases, Personal Data from publicly available sources (e.g. business directories).

 

5. THE PURPOSES OF THE PROCESSING OF PERSONAL DATA

 

The purposes for which we collect and Process Personal Data about our Customers are as follows:

 

1. for customer account management purposes (processing orders, invoicing, tax collection, etc.);

2. to fulfil our contractual obligations and to provide our products and services to our Customers;

3. to provide and send information and notifications to our Customers regarding the products or services purchased by our Customers and their condition and quality;

4. to handle any questions, complaints or claims from our Customers regarding services purchased from WAMP;

5. for direct marketing, advertising and public relations purposes in connection with WAMP's business and services, and to inform our Customers of significant changes within WAMP;

7. compliance with applicable laws regarding product quality and liability and, where applicable, compliance with laws and regulations and the exercise or protection of WAMP's rights under the law;

8. to help us run our business more efficiently and effectively, and to monitor and improve the quality of our services;

9. to carry out analyses and statistical studies of our services for business development and internal reporting purposes;

10. conducting surveys, satisfaction surveys and studies with our customers;

11. evaluating performance;

12. investigating violations of the law or other WAMP policies.

 

 

6. LAWFULNESS OF PROCESSING

 

Where necessary, we collect and process personal data in order to perform our agreement with you (i.e. to provide our products and services to you). In some cases we may need to process your personal data to comply with applicable laws. In such cases, we need to process your personal data in order to comply with a legal or contractual requirement. Without your personal data, we cannot manage our relationship with you or comply with applicable laws.

 

Where required by applicable law, we will ask for your prior consent before processing your personal data (e.g. for direct marketing purposes).

 

 

In all other cases, we will process your personal data where such processing is in our legitimate interest and does not violate your privacy interests or fundamental rights and freedoms. 7. WITH WHOM DO WE SHARE YOUR PERSONAL DATA?

 

We take care to only allow access to personal data to those who need to have such access in order to carry out their duties and responsibilities, and to third parties who have a legitimate purpose for access. Whenever we grant a third party access to Personal Information, we will take appropriate measures to use the information in accordance with this Notice and to maintain the security and confidentiality of the information.

 

7.1 Disclosure to our collaborating partners

 

We may share or provide access to your Personal Information with other partners of WAMP to facilitate the management and administration of our Customer Accounts for direct marketing purposes and other legitimate business purposes.

 

7.2 Disclosure to third party service providers

 

We also make certain personal data available to third party service providers who provide us with data processing services, for example in the context of information technology platform management or support services, infrastructure and application services, marketing, data analysis, etc. We may also disclose Personal Information to outside consultants, attorneys and experts who provide us with assistance related to our business. We will do so on a "need to know" basis and in accordance with the relevant data protection law.

 

7.3 Disclosure to public bodies

 

We will also disclose personal data to public bodies, such as national tax authorities, in accordance with applicable law.

 

7.4 Disclosure to other third parties

 

We may disclose personal information to other third parties on other legal bases, including:

7.4.1 To comply with our legal obligations, including, where applicable, to comply with the terms of a law, regulation or contract, or to respond to a judicial decision, administrative or judicial proceeding, including, without limitation, a subpoena, government inspection or search warrant;

7.4.2 To respond to lawful requests by public authorities (including for national security or law enforcement purposes);

7.4.3 As necessary to identify, exercise or defend against potential, possible or actual litigation;

7.4.4 Where necessary to protect the vital interests of another person;

7.4.5 In connection with the sale, transfer or other conveyance of all or part of our Business;

8. STORAGE AND SECURITY OF PERSONAL DATA TRANSFERRED OUTSIDE THE EU/EEU

 

 

WAMP stores all personal data on its own servers within the European Economic Area (EEA). WAMP maintains appropriate administrative, technical and physical safeguards to protect the confidentiality and integrity of Personal Data against accidental or unlawful destruction, accidental loss, alteration, disclosure or access, misuse or any other unauthorized forms of processing of Personal Data in its possession. By adopting data protection laws and internal policies, WAMP requires secure handling at all appropriate technology infrastructure points.

9. RETENTION OF PERSONAL DATA

 

We will keep your personal data for as long as we have a legal relationship with you and for as long as required by applicable law. In general, this means that your personal data will be retained until the end of the contractual relationship with us and for as long as necessary for our ongoing legitimate business interests. Personal data will be retained for marketing purposes until you opt-out of marketing communications.

 

 

 

10. YOUR PRIVACY RIGHTS

 

You have the following rights under applicable data protection laws:

1. You have the right to obtain confirmation as to whether personal data relating to you is being processed and, if so, the right to access and request a copy of your personal data;

2. the right to request the correction of inaccurate personal data and the completion of incomplete personal data;

3. the right to request the erasure of your personal data and to restrict the processing of your personal data for certain legal reasons.

You have the right to object to the processing of your personal data on grounds relating to your particular situation where such processing is necessary for the purposes of WAMP's legitimate interests;

5. the right to request the portability of your personal data where the processing is carried out with your consent or on the basis of a contract and where the processing is carried out by automated means.

6.You have the right to withdraw your consent at any time if your personal data is processed with your consent.Withdrawal of consent will not affect the lawfulness of any processing we carried out before your withdrawal, nor will it affect the processing of your personal data on lawful legal grounds other than consent.

7. You also have the right to opt-out of marketing communications from us at any time. You may exercise this right by clicking on the "unsubscribe" or "opt-out" link in any marketing communications we send you. To opt-out of other forms of marketing (such as postal marketing or telemarketing), contact us using one of the contact details set out in section 14 below.
